1.1 General Information
Tubbercurrie Terriers is an ANKC-registered Jack Russell Terrier breeder operating under Dogs Australia regulations and the relevant state canine body Dogs Queensland Code of Ethics.
By accessing this website, submitting an enquiry, or purchasing a puppy, you agree to these Terms & Conditions.
1.2 Puppy Availability & Pricing
Puppy availability is not guaranteed until a non-refundable deposit is received and confirmed in writing.
Pricing may vary between litters and is subject to change until a deposit is paid.
Tubbercurrie Terriers reserve the right to refuse a sale if a home is deemed unsuitable for the welfare of the puppy.
1.3 Health & Veterinary Care
All puppies leave with:
ANKC pedigree registration
DNA Parent verified through a qualified laboratory
Microchip
First vaccinations & worming
Veterinary health check
Any known health concerns will be disclosed prior to sale.
No guarantees are made regarding size, coat type, working ability, breeding suitability, or future performance/show outcomes.
1.4 Buyer Responsibilities
All costs, responsibility, welfare obligations, and decision-making transfer to the new owner once the puppy leaves the breeder’s care.
Owners agree to provide appropriate food, secure housing, socialisation, veterinary care, training, and mental stimulation.
Puppies must never be surrendered to a shelter or sold without notifying the breeder. See 3.3
1.5 Breeder Right to Withdraw
The breeder may withdraw a puppy from sale at any time, including after a deposit is paid, if this is in the best interest of the puppy.
Payments will be refunded in full if the cancellation is breeder-initiated.

All images, text, branding, and media on this site are the property of Tubbercurrie Terriers and may not be copied or reproduced without written permission.
Cancellations & Rescheduling Policy
2.1 Deposits
Deposits are non-refundable.
Deposits may be transferred to a future litter at the breeder’s discretion and subject to availability.
2.2 Buyer-Initiated Cancellations
Change-of-mind cancellations result in forfeiture of the deposit.
For cancellations after full payment:
A refund may only be considered if a suitable new home is found,
Less any costs incurred (advertising, veterinary expenses, administrative fees, extended care).
2.3 Breeder-Initiated Cancellations
If the breeder cancels the sale for welfare, ethical, or medical reasons, all payments will be refunded in full.
2.4 Collection & Rescheduling
Puppies must be collected during the agreed timeframe unless alternate arrangements are approved.
Boarding fees may apply for extended stays beyond the scheduled pick-up date.
Pickup times may be rescheduled by the breeder if needed due to weather, veterinary appointments, or animal welfare considerations.
3. Health Guarantee & Return Policy
3.1 Early Puppy Health Guarantee
Puppies leave after a veterinary health check confirming they are fit for sale at that time.
Buyers should arrange a check with their own veterinarian within 72 hours of collection.
Any concerns must be reported promptly with written veterinary evidence.
3.2 Genetic Health
Breeding dogs are health-tested where relevant to ANKC recommendations for the breed.
Should a hereditary issue be identified within a set timeframe (typically 6–12 months), the breeder may offer:
A partial refund,
A replacement puppy in a future litter, or
Another mutually agreed resolution.
Conditions arising from injury, neglect, poor diet, or environmental factors are excluded.
3.3 Lifetime Return-to-Breeder Policy
If the owner can no longer keep the dog at any stage of its life, Tubbercurrie Terriers must be notified first.
The dog must never be surrendered to a shelter or rehomed without approval.
The breeder will assist in rehoming; refunds for adult dogs are not guaranteed.
4. Privacy Policy
4.1 Information We Collect
Tubbercurrie Terriers collects personal information such as:
Name
Email address
Phone number
Location (general area/suburb)
Puppy application details
Transport information where required
This may be collected through website contact forms, email, phone, social media messages, or puppy applications.
4.2 How We Use Your Information
Your information is used solely for purposes related to:
Responding to enquiries
Assessing suitability for puppy placement
Puppy application and approval processes
ANKC registration requirements
Transport or travel arrangements for puppies
Maintaining breeder-buyer contact
Sending updates related to your puppy (if applicable)
4.3 Storage & Security
Personal information is stored securely and is accessible only to the breeder.
We take reasonable steps to protect your information from misuse, loss, or unauthorised access.
4.4 Sharing of Information
We do not share or sell your information to third parties, except where required for:
ANKC registration
Veterinary documentation
Mandatory microchip databases
Transport providers (only when organising puppy travel)
Legal or regulatory compliance (if required)
4.5 Access & Corrections
You may request access to the information we hold about you and ask for updates or corrections at any time.
4.6 Photo & Media Consent
Buyers may give consent for Tubbercurrie Terriers to share photos or updates of their puppy via social media or the website.
Consent can be withdrawn at any time by written request.
5. Puppy Purchase Agreement
Your puppy booklet constitutes a Puppy Purchase Agreement. It includes:
Detailed puppy identification
Microchip, vaccination & vet history
Registration type (Main or Limited Register)
Desexing expectations (if applicable)
Return-to-breeder clause
6. Ethical Breeding Statement
Tubbercurrie Terriers operate with a focus on health, temperament, and correct Jack Russell Terrier type.
Litters are carefully planned, responsibly raised, and socialised within a family home environment.
The welfare of all dogs and puppies is the breeder’s highest priority.
7. Complaints & Dispute Resolution
Any concerns should be raised directly with Tubbercurrie Terriers for resolution.
If required, disputes may be escalated to the relevant ANKC state body (e.g., Dogs Queensland).
Australian consumer law applies to all transactions.
1. Misrepresentation or False Information Clause
Many breeders face problems where buyers provide false information about their home, intentions, or breeding plans.
Tubbercurrie Terriers reserves the right to cancel a sale without refund if it is discovered that the buyer has provided false or misleading information during the enquiry or application process. This includes misrepresentation regarding living arrangements, intentions to breed, suitability, or ownership circumstances.
2. Social Media Conduct Clause
Buyers agree not to publish defamatory, misleading, or derogatory comments about Tubbercurrie Terriers, its dogs, or its breeding program on social media or public platforms. Any disputes should be handled privately and respectfully through direct communication. Legal action may be taken in cases of defamation, harassment, or reputational damage.
3. “No Breeding Without Written Permission” Clause
Even Limited Register puppies sometimes get bred illegally, leading to major disputes.
Puppies sold on the Limited Register are strictly not for breeding. Breeding from a Limited Register dog without written permission from Tubbercurrie Terriers is a breach of contract. The breeder may request the return of ANKC papers and take steps through Dogs Australia to have registration suspended or revoked.
4. Desexing / Breeding Control Clause
Useful when you want limited-register dogs desexed by a certain age.
Where desexing is required, buyers agree to have the dog desexed by the timeframe outlined in the contract. Failure to do so, or evidence of intentional breeding, may result in transfer papers not being signed or ANKC registration being cancelled or withheld.
5. Behavioural & Training Clause
Many breeders face claims that a dog is "aggressive" or "faulty" when in reality the puppy lacked training or socialisation.
Tubbercurrie Terriers is not responsible for behavioural outcomes resulting from lack of training, inappropriate handling, poor socialisation, or environmental influences. Terriers require ongoing training, enrichment, and responsible management. No refunds are given for behavioural issues arising after the puppy leaves the breeder’s care.
6. Size & Coat Expectation Clause
Many buyers try to claim dogs “grew too big”, “coat didn’t turn rough”, etc.
While parent information is provided as a guide, no guarantee is given regarding final size, coat length/type, or colouring. Terriers develop at varying rates and appearance may change as the dog matures.
7. Transportation Risk Clause
When transport is arranged by or on behalf of the buyer, all risk associated with travel transfers to the buyer once the puppy is handed to the transport provider. Tubbercurrie Terriers is not responsible for delays, travel-related illness, stress, or injury beyond our direct control.
8. 72-Hour Vet Check Dispute Clause
Any health concerns identified by the buyer’s veterinarian must be communicated in writing within 72 hours of collection. Concerns raised outside this period will not be eligible for health-related refunds or replacements unless otherwise required by law.
9. Return Clause
If an adult dog is returned at any stage of its life, Tubbercurrie Terriers will assist in rehoming the dog; however, refunds for adult dogs are not guaranteed and are provided solely at the breeder’s discretion.
10. No Guarantee of Showing, Breeding, or Working Success
No guarantees are made regarding a puppy’s future success in the show ring, agility, working ability, performance sports, or suitability for breeding programs, even when sold on Main Register.
